These Terms & Conditions apply to purchases made through the Tallulahs Swimwear website.

UK distance sellers must make their business identity, address and contact information available to customers before purchase.

Our products

Tallulahs sells swimwear, clothing, sleepwear, accessories and related products.

Many products are printed, cut, sewn or otherwise produced after an order is placed and are fulfilled on our behalf by third-party production partners including Printful.

Product specifications may vary slightly according to the fulfilment location. Where this affects important information such as textile composition, the relevant variations will be shown with the product information.

Product images and colours

We make reasonable efforts to display our products accurately.

However, colours can appear differently depending on your screen, device settings and lighting.

Products using all-over printing may also have small variations in the exact placement of artwork from one garment to another.

These normal production variations do not affect your rights if a product is materially different from its description.

Sizes

Please consult the relevant size guide before ordering.

Measurements are intended as a guide and minor manufacturing tolerances may occur.

Nothing in our sizing information limits your statutory rights.

Prices

Prices will be displayed in the currency shown on the website.

Any shipping charges and taxes collected by Tallulahs will be displayed before you complete your order.

Depending on the destination, additional import duties or local taxes may become payable after dispatch where these have not been collected at checkout.

Placing an order

When you place an order, you are offering to purchase the products shown in your order.

We may refuse or cancel an order where reasonably necessary, including where:

payment has not been authorised; there is an obvious pricing or product error; fraud or misuse is reasonably suspected; the product cannot be produced; or the requested delivery destination cannot be serviced.

If we cancel an order after taking payment, we will refund the relevant amount.

Payment

Payment must be completed using one of the payment methods offered at checkout.

Payment processing may be carried out by Shopify Payments or another payment provider displayed at checkout.

Tallulahs does not generally receive your complete payment-card details.

Production

Many products enter production shortly after an order is confirmed.

Please contact us as quickly as possible if you need to change or cancel an order.

We cannot promise that production can be stopped once it has begun, although this does not remove any statutory cancellation rights that subsequently apply.

Nothing in these Terms limits statutory rights relating to faulty, misdescribed or otherwise non-conforming goods.

Intellectual property

Unless stated otherwise, Tallulahs branding, original prints, artwork, graphics, photographs, written content and other original creative material belong to Tallulahs Swimwear or are used with permission.

You may not reproduce, copy, manufacture from, distribute, commercially exploit or use Tallulahs artwork or branding to create products without written permission.

Buying a Tallulahs product does not transfer any intellectual-property rights in the artwork or design to the purchaser.

Promotions and discount codes

Promotional offers may be subject to additional terms displayed when the promotion is offered.

Unless stated otherwise, discount codes cannot be exchanged for cash and may not be combined with another promotion.

We may withdraw or correct a promotion where there has been an obvious error or misuse.

Website availability

We aim to keep the website available and accurate but cannot guarantee uninterrupted access.

We may update products, pricing, availability, website features or content from time to time.

Liability

Nothing in these Terms excludes or restricts liability where doing so would be unlawful.

In particular, nothing in these Terms affects rights or remedies available to consumers under applicable consumer-protection law.

Events outside our control

We will not be responsible for delays caused by circumstances genuinely outside our reasonable control, but this does not remove any rights you have under applicable consumer law.

Governing law

These Terms are governed by the laws of England and Wales.

If you are a consumer living outside England and Wales, this does not deprive you of mandatory consumer protections that apply to you under the laws of your country where those protections cannot legally be excluded.
